How long is tender resignation period?

If employee tenders resignation after 4 months of employment with no documentation of probationary extension or confirmation letter, clause is during probation is 1 month notice and confirmed employee is 2 months notice, which should be served?

I would say that the staff is NOT deemed as a confirmed staff. They'd only need to serve 1 month notice.
