Staff under probation can resign due to poor performance?

This is because they didn't want to issue a termination letter. There is no show cause letter, no performance appraisal but just have 2 warning letters. That staff can claim at the labor dept?

Just sharing. my company just gives her/him 7-days notice as stated in the offer letter whereby both parties can end the contract by giving 7days to each party.

If under probation, proceed with non-confirmation. However pls ensure all the evaluation are in place.

Agreed with the comment above refer back to what is stated in your offer letter. Mine, if still under probation its 7days notice from both sides

The Company have to justify for the non-confirmation with evidence, not just blindly follow the contract.
