离职后薪水发放的问题,你知道有关法律规定吗?

25/3是我在公司的最后一天,照理公司应该就得把薪水算到这一天发给我是吗?后来我想反正再过几天也就是31号就是发薪水的日子了,那么就别让公司的HR添麻烦,我这个月薪水(还包括一些monthly claims,如medical fee, mileage claim, etc) 就和其他员工一起出好了。 可是前几天我向HR 确认,她却说依照公司的HR policy, 这个三月公司会先把1/3-15/3的薪水发给我,至于16/3-25/3的薪水会等到4月发薪水时才发给我。。。请问这公司能这样做的吗?我还和HR说据我所知,根据劳工法令,公司如果不能在员工最后一个工作日出完薪水的话,那么至少必须在员工离职以后的7天内把所有薪水发出去,HR 依旧说他们一直以来都是根据公司的HR policy来办事,那么请问各位HR policy可以凌驾于马来西亚劳工法令之上吗?接下来我该怎么做,请各位教教我。 (注明:我的薪水是马币5000以上,是否也能受到劳工法令的保护?)

According to the Employment Act 1955 in Malaysia, employers are required to pay all outstanding wages to an employee within 7 days after the termination of employment. This includes any salary, allowances, and claims owed to the employee. HR policies cannot override the provisions of the law, so in this case, the company should pay the full salary, including the period from 16/3-25/3, within 7 days of your last working day. As your salary is above RM 5000, you are entitled to the protection under the Employment Act. If the company fails to comply with the law, you may seek assistance from the Department of Labor or take legal action to claim your unpaid wages.
